BIOGRAPHY

Lindsey Wyrick devotes her practice to professional liability defense and commercial litigation. She is best known for her representation of lawyers, CPAs, and other professionals in all aspects of litigation and administrative proceedings. Lindsey also assists her clients with ethics issues, professional regulations, and risk management, including on emerging technology and cybersecurity issues.

Known by her clients as a proactive problem solver with a dedicated, detail-oriented approach to her practice, Lindsey makes it her mission to understand her client’s business and practice from the outset, so that her work advances their goals. Throughout the proceeding, Lindsey looks for ways to be creative and strategic to bring about the best outcome for the client.

Lindsey enjoys helping other professionals navigate and solve complex legal issues. And whether her clients are currently involved in disputes or not, she advises them on possible risk exposure in their practices and counsels them on risk mitigation strategies to avoid litigation.

Experience

Lindsey has obtained summary judgment dismissals for her lawyer and accountant clients on numerous occasions, including on the issues of anti-fracturing of a legal malpractice claim, expert testimony requirements, and proof of causation and damages.

In addition, Lindsey has achieved successful outcomes in the following trials and arbitrations:

  • With co-counsel, obtained an arbitration award for Austin law firm for significant unpaid contingency fee and successfully defended against claims of malpractice and breach of fiduciary duty arising out of complex probate matter.
  • With co-counsel, after a five-day jury trial, defeated claims against lawyer client related to the alleged mishandling of a suit on a guaranty and recovered judgment for lawyer’s unpaid legal fees.
  • With co-counsel, obtained an arbitration award dismissing the malpractice claims against a large Texas law firm related to the handling of a divorce case, and granting the firm its unpaid attorneys’ fees.
  • With co-counsel, limited the damages found by jury against law firm client in a second legal malpractice trial to less than $23,000 when prior jury, with client represented by other counsel, had awarded damages in excess of ten times that amount.
  • With co-counsel, successfully defended tax preparer clients in a federal court bench trial of a U.S. Government action to obtain injunctive relief related to complex tax shelters.
  • As part of a trial team, obtained jury verdict for full amount of the unpaid professional fees and a directed verdict on malpractice counterclaims related to forensic accounting work performed by the client for a multi-million dollar real estate development.
