Construction

The planning, design and oversight of construction projects typically involve many different parties and levels of complexity that require legal guidance. Our attorneys are highly experienced in managing risk and identifying and resolving potential legal issues on behalf of a full range of construction-related professionals, including architects, engineers, surveyors, general contractors, subcontractors, and material suppliers. This work has involved:  

  • Drafting and negotiating proposals and contracts between owners, general contractors, design professionals and consultants  
  • Negotiating change orders, claims for extra work or materials, requests for extensions of project schedules, and claims for extended general conditions  
  • Reporting and investigation of construction site injuries 
  • Filing and foreclosing on Mechanic’s, Contractor’s, and Materialman’s liens, as well as assisting owners with removing these liens from their properties.  
  • Pursuing collection of contract debts  
  • Negotiating labor and employment issues, such as terminations 
 

Each of these responsibilities involves managing risk and identifying and resolving potential legal issues. When a resolution cannot be achieved, we have the experience to provide sophisticated representation in all aspects of construction litigation, frequently involving multiple parties, highly technical documents, and complex indemnity relationships for commercial, residential and industrial construction projects, as well as transportation infrastructure, public utilities and power plants, sports and recreation venues, convention facilities, flood control, and water treatment and sewage facilities.  

Our lawyers have a demonstrated and proven record of success in litigating and resolving construction claims in Texas and federal trial and appellate courts, before administrative and regulatory tribunals, and before arbitration panels in several types of construction disputes, including: 

 

  • Construction Defects – defending parties sued for alleged construction defects such as floor defects, wall defects, window defects, and soil subsidence. 
  • Design Defects and Defective Specifications – defending parties sued for alleged defects in design and documentation that result in alleged performance failures. 
  • Construction Injuries – defending parties accused of negligence in personal injury claims associated with construction accidents. 
  • Construction Contract Disputes – representing both plaintiffs and defendants in disputes over the interpretation and enforcement of construction contracts.  
  • Contract Execution Disputes – resolving disputes arising from delay, disruption, interference, and loss of productivity on the project site.
