BIOGRAPHY

Jennifer Smiley is an associate whose practice centers on professional liability defense and employment law. She represents lawyers, accountants, engineers, architects, and other professionals and businesses in state and federal courts. 

Jennifer graduated cum laude from SMU Dedman School of Law, and, prior to joining the firm, served as a term law clerk for the Honorable David B. Fannin in the U.S. District Court for the Western District of Texas. As a law clerk, she gained extensive experience through analyzing a variety of cases from initial filing through final judgment.

Experience

Jennifer has achieved successful outcomes in the following representative engagements: 

  • Prevailed on a Motion to Dismiss for lack of personal jurisdiction in federal court for an insurance agent in a complex coverage dispute.  
  • Secured a summary judgment in the defense of legal malpractice and breach of fiduciary duty claims due to lack of evidence that the attorney was responsible for any damages in the property division of a client’s divorce. 
  • Prevailed on a motion to dismiss legal malpractice and breach of fiduciary duty claims related to an attorney’s representation of an alleged former client.
