Appearing Before Panels Throughout Texas
Often urged as a cost-effective alternative to litigation, arbitration also has the potential to limit parties' ability to protect their interests and enforce their contractual rights. At Cobb Martinez Woodward PLLC, we help our clients evaluate which disputes are suited to advantageous arbitration, and which can be more effectively pursued in the courts.
The lawyers at our Dallas-based firm understand how to advocate for our clients' interests within the unique rules and procedures established by a range of Texas and national alternative dispute resolution (ADR) organizations and arbitration panels.
Arbitrating Disputes Across a Range of Substantive Practice Areas
While voluntary arbitration may be a possible course of action in most any type of litigation, arbitration is typically implicated when a contract at issue in a dispute contains a mandatory arbitration clause. These clauses are particularly common in the following types of contracts:
- Financial services contracts: Many contracts between investors and financial institutions contain clauses requiring that any disputes be resolved through arbitration before the Financial Industry Regulatory Authority (FINRA).
- Construction contracts: Many construction industry contracts - including many of the standard form contracts distributed by the American Institute of Architects (AIA) - also contain mandatory arbitration clauses.
- Health care contracts: An increasing number of health care providers are entering into contracts with insurance companies and employers to provide discounts contingent on prompt payment. These contracts very often contain arbitration clauses.
CMW attorneys are familiar with arbitration's unique procedures and evidence rules. We have also had success enhancing our arbitration presentations with evidence obtained in limited depositions and other means of discovery.
If you face a dispute that is in arbitration or may end up there, we encourage you to contact us at our offices in Dallas to schedule a consultation.
